This Week in Weed: May 10

NEW YORK (TheStreet) -- This is a weekly roundup of news from the cannabis industry for the week of May 10.

NIDA Needs More Weed

The drug enforcement agency posted a notice on Monday that the National Institute of Drug Abuse, or NIDA, needs more pot. A lot more pot. They want their quota increased from 21,000 grams to 650,000 grams. So instead of roughly 46 pounds, they need 1,433 pounds.

NIDA oversees the cultivation, production and distribution of research-grade marijuana on behalf of the U.S. and NIDA needs more pot to meet its research efforts. As of January, NIDA had funded 28 active grants related to therapeutic uses of marijuana in six different disease categories covering AIDS, pain, schizophrenia, seizures and hard drug withdrawal. So, where does NIDA get its pot? At the University of Mississippi, the United States' only legal marijuana farm. But before Ole Miss starts planting more seeds, the DEA has opened this request for public comments until June 4th.

WATCH: Federal Government Needs More Marijuana for Research Studies Colorado Approves Cannabis Credit Co-ops Colorado legislators took the banking problem for cannabusinesses into their own hands by approving House Bill 1398 to create cannabis credit co-ops. Marijuana businesses have had a difficult time when it comes to banking. The big banks remain uncomfortable dealing with businesses whose product is illegal on the federal level. The justice department tried to address the issue with a weakly worded memo which the banks did not find very reassuring. The co-ops will have to get approval from the Federal Reserve in order to offer credit cards and checking accounts and that doesn't seem likely. If the Federal Reserve were to approve this, it could open up a huge can of worms for other illegal businesses to request their own special banks. Many dispensaries in Colorado advertise that they accept credit cards even though the credit card companies insist they don't work with marijuana businesses. So, it seems as if they've resolved the credit card problem already. However, paying vendors and employees is still an issue. The Colorado bill states that the credit co-op would only be available to entities that are licensed to own or operate a marijuana business. If you go out of business, you are out of the co-op. And it isn't just about the businesses. Colorado also says in the bill that the lack of banking hurts the state's ability to track and verify the accounting of a licensed marijuana business. Still the co-ops aren't all rainbows and unicorns. The deposits at the co-ops can be subject to seizure by the federal government and are not federally insured, plus the state of Colorado won't defend the co-op in the event of a seizure.

Minnesota Moves Closer to MMJ


The Minnesota Senate approved a bill to create a medical marijuana program. The vote was bipartisan with 48 in favor and 18 against. The Senate bill allows patients suffering from cancer, glaucoma, AIDS, epilepsy and MS to obtain up to 2.5 ounces of medical marijuana and toughens the penalty against patients that divert their supply. It would permit 55 distribution centers in the state.

The bill now goes to the Minnesota House where there is a different, more restrictive bill. The House bill would create a study, not a system of distribution. Smoking marijuana is prohibited by both bills.

The Minnesota Department of Health would be in charge of implementing the program if it is approved. Governor Mark Lawton had initially opposed the bill, but now says he'll consider the patients' needs too. The Minnesota House is expected to consider the measure on Friday. If the state legalizes medicinal marijuana, it will become the 22nd state to do so. Written by Debra Borchardt in New York.

Top 10 Low Price Companies To Buy For 2015

LONDON -- Tesco
After trading as high as 385 pence in May, shares in�Tesco� (LSE: TSCO  ) (NASDAQOTH: TSCDY  ) were today down at 328 pence. That's a 15% fall in just one month. However, Tesco's low price-to-earnings ratio and significant dividend yield will now be attracting value and income investors.

Tesco is forecast to pay a dividend of 15.2 pence for the full year. At today's price, that's a 4.6% yield. If the supermarket manages to hit expectations for the year of 32.9 pence, the forecast P/E is just 10. According to my statistics, only nine other shares in the FTSE 100 are cheaper on both metrics.

Tesco is not excruciatingly cheap. That said, it's more than three years since the shares spent any meaningful time under 300 pence.

Croda International
Croda International� (LSE: CRDA  ) is one of the FTSE 100's great success stories. Five years ago, the company had just reported 33.5 pence of earnings per share and the shares traded hands for 631 pence. Fast-forward to today, and 137 pence of EPS is expected for the full year. The shares are now priced at 2,260 pence.

Shares of Staples (SPLS) may have popped nearly 7 percent higher after the company posted a larger-than-expected profit a few days ago, but it's still in a bit of a funk. Quarterly sales fell for the seventh quarter in a row. Profitability improved, but largely on the closure of 127 underperforming stores, with another 43 or so to go before the year is over. Yes, fewer stores will naturally hold back overall sales growth, but it's important to point out that comparable-store sales at Staples in North America still fell a problematic 4 percent during the period. There's no "Easy" button to escape what the trend is telling investors. Business Before Pleasure This should be a great time for a superstore selling office supplies. The economy's improving. Unemployment rates are heading lower. Interest rates are low, making it easier for entrepreneurs to finance new ventures. The climate of the industry itself should also be faring well. Office Depot (ODP) completed the merger with OfficeMax, combining the industry's second- and third-largest players to give everybody else one fewer price-slashing competitor to worry about. Unfortunately, it wasn't just the cutthroat ways of Office Depot and OfficeMax holding Staples back. Amazon.com (AMZN) continues to become a retail juggernaut, and the popularity of speedy, reliable and cost-effective Prime deliveries to corporations of all sizes is on the rise. There's also the challenge of traditional big-box discount department store chains that are loading up on business essentials. Let's also not forget the telecommuting and contractor trends that translate into companies not having to stock as many supplies as they used to. Calling in Sick to Work Wall Street pros know that this isn't going to be a near-term turnaround. They see sales and earnings declining this holiday quarter relative to last year's showing. The

Encore Wire Corporation (Encore), incorporated on April 5, 1989, is a manufacturer of electrical building wire and cable.     Another earnings short-squeeze prospect is packaged specialty rice and other food products distributor Amira Nature Foods (ANFI), which is set to release numbers on next Monday after the market close. Wall Street analysts, on average, expect Amira Nature Foods to report revenue of $132.37 million on earnings of 32 cents per share.

    The current short interest as a percentage of the float for Amira Nature Foods is extremely high at 26.6%. That means that out of 17.70 million shares in the tradable float, 4.72 million shares are sold short by the bears. The bears have also been increasing their bets from the last reporting period by 8.2%, or by 356,000 shares. If the bears get caught pressing their bets into a bullish quarter, then shares of ANFI could easily rip sharply higher post-earnings as the shorts move fast to cover some of their trades.

    From a technical perspective, ANFI is currently trending above its 200-day moving average and just below its 50-day moving average, which is neutral trendwise. This stock just recently bounced higher off some near-term support at $15.25 a share. That bounce is starting to push shares of ANFI within range of triggering a near-term breakout trade post-earnings.

    If you're bullish on ANFI, then I would wait until after its report and look for long-biased trades if this stock manages to break out above some near-term overhead resistance levels at $17 to $17.98 a share and then above more resistance at $18.52 a share with high volume. Look for volume on that move that registers near or above its three-month average action of 174,102 shares. If that breakout develops post-earnings, then ANFI will set up to re-test or possibly take out its next major overhead resistance levels at $19.86 to $20.29 a share, or even its 52-week high at $25 a share.

    I would simply avoid ANFI or look for short-biased trades if after earnings it fails to trigger that breakout and then drops back below some key near-term supp

    A consumer goods player that's starting to trend within range of triggering a big breakout trade is Amira Nature Foods (ANFI), a global provider of packaged Indian specialty rice, with sales in over 40 countries. This stock has been in play with the bulls over the last three months, with shares up 25%.

    If you take a look at the chart for Amira Nature Foods, you'll notice that this stock has been uptrending strong for the last five months, with shares soaring higher from its low of $7.44 to its recent high of $17.41 a share. During that uptrend, shares of ANFI have been making mostly higher lows and higher highs, which is bullish technical price action. Shares of ANFI have started to break out above some key near-term overhead resistance levels today at $15.92 to $16.25 a share. That move is quickly pushing shares of ANFI within range of triggering another big breakout trade.

    Traders should now look for long-biased trades in ANFI if it manages to break out above its all-time high of $17.41 a share with high volume. Look for a sustained move or close above that level with volume that hits near or above its three-month average action of 226,387 shares. If that breakout triggers soon, then ANFI will set up to enter new all-time-high territory, which is bullish technical price action. Some possible upside targets off that breakout are $25 to $27 a share.

    Traders can look to buy ANFI off any weakness to anticipate that breakout and simply use a stop that sits right below its 50-day at $15.03 a share or around more key near-term support at $14.72 a share. One could also buy ANFI off strength once it starts to clear $17.41 a share with volume and then simply use a stop that sits a comfortable percentage from your entry point.

    PPG Industries, Inc. (PPG) announced on Monday morning that it has agreed to acquire Consorcio Comex, S.A. de C.V.

    PPG will acquire architectural and industrial coatings company Consorcio Comex for approximately $2.3 billion. The deal is subject to regulatory approvals and customary closing conditions. PPG reported that it plans to fund the deal with currently held cash and short term investments.

    Comex is Mexico-based coatings manufacturer that sells its products in 3,600 stores in Mexico and Central America. The company is a privately held company and�was founded in 1952.

Universal Truckload Services, Inc., incorporated on December 11, 2001, is engaged in providing transportation services to shippers throughout the United States and in the Canadian provinces of Ontario and Quebec. MINNEAPOLIS (AP) ��Higher fares and growing traffic helped Delta Air Lines post a bigger-than-expected profit on Tuesday.

Shares jumped 4% to $32.35 in early trading on the report.

Delta's yield ��a key measure of what each passenger pays to fly one mile ��rose 4% for the quarter. Airlines tried about a dozen fare increases last year, although most failed when competitors didn't match them.

Delta President Ed Bastian said demand for air travel is "solid," and Delta expects to see "significant margin expansion" in the current quarter.

Bastian also said the airline industry is showing restraint in how much flying it adds. The view on Wall Street has been that reining in growth will give airlines more power to raise fares. Delta expanded flying just 1% last year. It said it expects to grow 2% to 3% in the upcoming quarter.

    Tulsa World reports:

    Oklahoma Attorney General Scott Pruitt is continuing to press for the merger of American Airlines and US Airways, telling a court in Washington, D.C., that he intends to file for “friend of the court” status for the upcoming trial in an antitrust lawsuit brought by the Justice Department.

    Pruitt’s announcement Wednesday came the same day as mayors of seven cities, all with American and US Airways hubs, sent a letter to U.S. Attorney General Eric Holder asking him to withdraw the lawsuit.

    Michael Linenberg�also raised US Airways to Buy from Hold. Analyst Michael Linenberg and team explain:

    We are raising our rating on US Airways’s shares from Hold to Buy based on an improved fundamental outlook that, in our opinion, transcends the potential uncertainty surrounding the company’s proposed merger with American which has been blocked by the DOJ. The improvement observed in the Sep Q (e.g. pretax margin expanded 4 points to 9.5%) combined with material revisions to our 2013 and 2014 EPS estimates underlie a revised 12 month price target of $30 implying upside of 40% for LCC shares. We believe that math is too compelling to disregard despite regulatory uncertainty that may not be resolved until early 2014.

    Shares of AMR Corp. have gained 9.7% to $6.91–just 3.4% from its 52-week high–while US Airways has risen 5.5% to $22.57. Southwest Airlines (LUV) has advanced 3.4% to $16.96, Delta Air Lines (DAL) has jumped 2.6% to $26.27 and JetBlue Airways (JBLU) is up 2.9% at $12.31.

    Most airlines are profitable today; even bankrupt American Airlines (NASDAQOTH: AAMRQ  ) recently announced that it earned a profit (excluding one-time items) in the seasonally weak Q1. However, because the industry is cyclical, profitability today does not guarantee that these companies will remain profitable over a long period of time. For the most part, airlines are not growing rapidly, either. In fact, many are shrinking.

As of December 31, 2011, SkyWest Airlines and ExpressJet scheduled the daily flights as Delta Connection carriers: 530 flights to or from Hartsfield-Jackson Atlanta International Airport, 316 flights to or from Salt Lake City International Airport, 132 flights to or from Minneapolis International Airport, 94 flights to or from Memphis International Airport, 94 flights to or from Detroit International Airport and 8 flights to or from Cincinnati/Northern Kentucky Inte! rnational! SkyWest Airlines provides regional jet and turboprop service primarily located in the midwestern and western United States. SkyWest Airlines offered approximately 1,650 daily scheduled departures as of December 31, 2011, of which approximately 1,110 were United Express flights, 500 were Delta Connection flights, 30 were Alaksa-coded flights and 10 were US Airways Express flights. SkyWest Airlines' operations are conducted from hubs located in Chicago (O'Hare), Denver, Los Angeles, Houston, Portland, Seattle, Phoenix, San Francisco and Salt Lake City. SkyWest Airlines' fleet as of December 31, 2011 consisted of 21 CRJ900s, all of which were flown for Delta; 96 CRJ700s, of which 70 were flown for United, 21 were flown for Delta and five were flown for Alaska; 153 CRJ200s, of which 82 ! were flown! for United, 61 were flown for Delta, eight were in preparation for service under a code-share agreement with US Airways and two were flown for US Airways; and 45 Brasilia turboprops, of which 35 were flown for United and 10 were flown for Delta.

As of December 31, 2011, SkyWest Airlines was conducting its Delta Connection operations pursuant to the terms of an Amended and Restated Delta Connection Agreement, which obligates Delta to compensate SkyWest Airlines for its direct costs associated with operating Delta Connection flights, plus a payment based on block hours flown (the SkyWest Airlines Delta Connection Agreement). SkyWest Airlines' United code-share operations are conducted under a United Express Agreement, pursuant to which SkyWest Airlines is paid primarily on a fee-per-completed block hour and departure basis, plus a margin based on performance incentives (the SkyWest Airlines United Express Agreement). During December 31, 2011, SkyWest Airlines entered into code-share agreements with Alaska and US Airways, pursuant to which SkyWest Airlines is paid primarily on a fee-per-completed block hour and departure basis, plus a fixed margin per aircraft each month.

ExpressJet

ExpressJet provides regional jet service principally in the United States, primarily from hubs located in Atlanta, Cleveland, Cincinnati, Chicago (O'Hare), Denver, Houston, Newark and Washington Dulles. ExpressJet offered more than 2,100 daily scheduled departures as of December 31, 2011, of which approximately 650 were Delta Connection flights and 1,450 were Continental Express or United Express flights. As of December 31, 2011, the combined fleet of ExpressJet consisted of 10 CRJ900s, which were flown for Delta, 46 CRJ700s,which were flown for Delta, 113 CRJ200s, 99 of, which were flown for Delta and 14 of, which were flown for United and 242 ERJ145s, which were flown for United or Continental.

Under the terms of a Second Amended and Restated Delta Connection Agreement exec! uted betw! een Delta and Atlantic Southeast and to, which ExpressJet is a party (the ExpressJet Delta Connection Agreement), Delta has agreed to compensate ExpressJet for its direct costs associated with operating Delta Connection flights, plus, if ExpressJet completes a certain minimum percentage of its Delta Connection flights, a specified margin on such costs. Under the ExpressJet Delta Connection Agreement, excess margins over certain percentages must be returned to or shared with Delta, depending on various conditions. ExpressJet's Continental and United code-share operations are conducted under a Capacity Purchase Agreement between ExpressJet and Continental (the Continental CPA) and two United Express Agreements between ExpressJet and United (collectively, the ExpressJet United Express Agreements), pursuant to, which ExpressJet is paid by Continental or United, as applicable, primarily on a fee-per-completed block hour and departure basis, plus a margin based on performance incentives.

US Airways Group, Inc.
